1. Acceptance of Terms

By creating an account, submitting a search, or otherwise using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and the Company.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

IsMySpouseHidingDebt.com provides access to publicly available records including court judgments, tax liens, bankruptcy filings, UCC filings, civil litigation records, and property liens. Our service aggregates and presents information that is legally accessible to the public through government and court databases.

We are a public records search service. The records we surface are the same records accessible by anyone at a courthouse, through government portals, or via Freedom of Information Act requests - we simply make searching them faster and easier.

3. Eligibility

To use this Service, you must:

• Be at least 18 years of age
• Be a resident of the United States
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from receiving our services under applicable law

By using the Service, you represent and warrant that you meet all eligibility requirements. We reserve the right to terminate access for anyone who does not meet these requirements or who misrepresents their eligibility.

4. User Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree that:

• You will provide accurate information when creating an account or submitting a search
• You will use search results for personal, informational purposes only
• You will NOT use search results to make credit decisions about any individual
• You will NOT use search results for employment screening or background checks
• You will NOT use search results for tenant or rental screening
• You will NOT use search results for insurance underwriting decisions
• You will NOT use the Service to harass, stalk, or harm any individual
• You will NOT attempt to circumvent any security or access controls
• You will NOT use automated tools, bots, or scrapers to access the Service
• You will NOT resell or redistribute search results obtained through our Service

Violation of any of these restrictions may result in immediate termination of your account and potential legal action.

5. Accuracy Disclaimer

Public records databases are maintained by thousands of different government entities across the United States. Record accuracy, completeness, and timeliness vary significantly by jurisdiction. We make no representations or warranties regarding:

• The accuracy, completeness, or currency of any public record
• Whether all relevant records have been returned for a given search
• Whether records attributed to a name belong to the specific individual you are searching
• Whether dismissed, expunged, or sealed records may appear or be missing

Search results should be used as a starting point for further investigation, not as a definitive statement of any individual's financial history. Do not make important financial, legal, or personal decisions based solely on search results from our Service.

The Company expressly disclaims all warranties, express or implied, regarding the accuracy or reliability of any information returned by our Service.

6. Payment Terms

Access to full search results requires a paid subscription or one-time purchase. By providing payment information and submitting a purchase, you agree to the following:

• Payment processor: All payment transactions are processed by Sticky.io, our third-party payment processor. Your payment information is governed by Sticky.io's terms and privacy policy.
• Subscription billing: If you purchase a subscription plan, your subscription will automatically renew at the end of each billing period (monthly or annually, as selected) at the then-current subscription rate.
• Auto-renewal notice: We will send a reminder email before your subscription renews. By continuing to use the Service after a renewal, you authorize the charge to your payment method on file.
• Cancel anytime: You may cancel your subscription at any time through your account settings or by contacting us at legal@ismyspousehidingdebt.com. Cancellation takes effect at the end of the current billing period.
• Price changes: We reserve the right to change subscription pricing. We will provide at least 30 days notice before any price increase takes effect for existing subscribers.

7. Refund Policy

Our refund policy is designed to be fair to users while accounting for the real cost of running public records searches:

• Completed searches - no refund: Once a search has been executed and results have been delivered (including results showing no records found), the service has been rendered. Completed searches are not eligible for refund.
• No records found - refund available: If our system returns absolutely no results for your search - meaning we found no public records whatsoever matching the name and state provided - you may request a full refund within 7 days of the search. This applies to one-time purchases only.
• Technical failures: If you were charged but our system failed to deliver any results due to a technical error on our end, you are entitled to a full refund or a free repeat search, at your option.
• Subscription refunds: Subscription payments are non-refundable once a billing period has begun. You may cancel to prevent future charges.

To request a refund, email legal@ismyspousehidingdebt.com with your name, account email, search date, and reason for the request. We process refund requests within 5 business days.

8. Intellectual Property

The Service and all of its original content, features, functionality, design elements, and software are owned by the Company and are protected by United States and international intellectual property laws.

Public records data returned by search results is, by nature, in the public domain. However, our compilation, formatting, presentation, and technology used to aggregate and display that data is proprietary and protected by copyright.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the Service or its proprietary content without our prior written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or other intangible losses
• Damages arising from your reliance on search results for any decision
• Damages arising from inaccurate, incomplete, or outdated public records
• Damages arising from unauthorized access to or alteration of your account
• Any other damages arising from your use or inability to use the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including privacy rights
• Your use of search results in a manner prohibited by these Terms or applicable law
• Any misrepresentation made by you in connection with the Service

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved as follows:

• Informal resolution first: Before filing any legal claim, you agree to contact us at legal@ismyspousehidingdebt.com to attempt to resolve the dispute informally. We will make a good-faith effort to resolve disputes within 30 days.
• Binding arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration in New York, New York, under the rules of the American Arbitration Association (AAA). Arbitration is final and binding on both parties.
• Class action waiver: You agree to resolve disputes on an individual basis only. You waive your right to participate in any class action lawsuit or class-wide arbitration.
• Small claims exception: Either party may bring claims in small claims court for disputes within that court's jurisdiction.

If any provision of this section is found to be unenforceable, the remaining provisions shall remain in full force.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and notify registered users by email at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription before the effective date.
